PAG-02 Re-issuance

DEP has announced the availability of the reissued PAG-02 General Permit  for Discharges of Stormwater Associated with Construction Activities (2024 PAG-02).

The existing (2019) PAG-02 General Permit expires on December 7, 2024. All existing permittees that wish to remain covered under the 2024 PAG-02 must submit a renewal NOI (3800-PM-BCW0405h) to the office that approved original coverage by December 7, 2024. A PAG-02 General Permit training course has been created in DEP’s Clean Water Academy to explain the differences between the 2019 and 2024 versions of PAG-02, how to complete the NOI, and more.

DEP’s Construction Stormwater and E&S Resources pages have been updated to include posting of the Chapter 102 PCSM Recording Checklist and Instructions as well as the PDSC Spreadsheet and FAQ for Erosion Potential Analysis.

 

Notice of Termination

NOT Form 3800-PM-BCW0229b should be used. The NOT Form should be completed as explained in the NOT Instructions (see 3800-PM-BCW0229a). If your Notice of Intent (NOI) or permit application was submitted prior to November 19, 2010 and your permit coverage was renewed prior to January 1, 2013, complete the NOT Form, but you may omit Sections 5, 6 and 7 and Appendices B and C.

The PAG-02 General Permit will expire on December 7, 2024. DEP expects that Notices of Intent (NOIs) to remain covered under the reissued PAG-02 General Permit will be required, and those NOIs will be due to the DEP or county conservation district office that approved original coverage by December 7, 2024. DEP expects to provide a streamlined renewal NOI form for this purpose. This form will not be available until PAG-02 is reissued (the current estimate is Fall 2024). Permittees that do not have Notice of Termination (NOT) approval by December 7, 2024 will need to submit a renewal NOI. However, DEP and county conservation districts cannot accept renewal NOIs for PAG-02 until DEP publishes the final reissued PAG-02 General Permit.
